SKWEEK.tv subscription (the "SKWEEK") is a digital content service owned by Fedcom Media SAM and operated by Endeavor Streaming Inc. SKWEEK provides a subscription service that allows members access to every Turkish Airlines EuroLeague and 7DAYS EuroCup games, including extra content such as classic videos and documentaries (the "SKWEEK Content") streamed over the Internet.

By checking the "I Accept" box or by otherwise accessing the SKWEEK you agree to be bound by these Terms of Use.

These Terms of Use govern your use of the platform and access to the SKWEEK Content.

You must read through and accept the latest version of these Terms of Use before subscription. You are encouraged to carefully read, download, and print the Terms of Use and to keep a copy.

1. SUBSCRIPTIONS

SKWEEK.tv subscription (the "SKWEEK") is a digital content service owned by Fedcom Media SAM and operated by Endeavor Streaming Inc. SKWEEK provides a subscription service that allows members access to every Turkish Airlines EuroLeague and 7DAYS EuroCup games, including extra content such as classic videos and documentaries (the "SKWEEK Content") streamed over the Internet.

2. MEMBERSHIP

a. Your SKWEEK membership will automatically renew at the end of each billing cycle, unless you cancel your subscription before the next renewal date (see Billing and Cancellation below for further information). To use SKWEEK you must have Internet access and provide us with one or more payment methods, which are current, valid and accepted method of payment (debit and credit cards are accepted), which you may update from time to time, and which may include payment through your account with a third party (“Payment Method”). Unless you cancel your subscription before your next billing date, you authorize us to charge you for your next subscription fee using your Payment Method.

b. We may offer a number of membership plans, including annual or monthly subscriptions as standalone or which auto-renew, special promotional plans or memberships offered by third parties in conjunction with the provision of their own products and services. Some membership plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you. You can find specific details regarding your membership by visiting our website and clicking on the "Account" section page.

3. BILLING AND CANCELLATION

a. Billing Cycle: the membership fee for the SKWEEK service and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly or annual basis (depending on your subscription) to your selected Payment Method on the calendar day corresponding to the commencement of the paying potion of your membership. In some cases, your payment date may change, for example if your payment method has not successfully settled or if your paid membership began on a date which does reoccur in the following month(s). b. Payment Methods: to use the SKWEEK services you must provide one or more Payment Methods. You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge the applicable Payment Method(s). You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used.

c. Exclusions from the right of withdrawal: according to Article L.221-28 1° of the French Consumer Code, the right of cancellation is excluded for contracts for the provision of services fully performed before the end of the withdrawal period and the performance of which has begun after the consumer has given his express prior consent and expressly waived his right of withdrawal.

d. Cancellation: You can cancel your subscription at any time, and you will continue to have access to the SKWEEK service up to and including the date which falls at the end of your current billing period (monthly or annual depending on your chosen subscription). To the extent permitted by the applicable law in your territory of residence, payments are non-refundable and we do not provide refunds or credits for any partial-month membership periods or unwatched SKWEEK content. To cancel, please send an email to helpdesk@fedcomgroup.com confirming your intention to cancel. If you cancel your subscription, your account will automatically close at the end of your current billing period. To see when your account will close, click "Billing details" on the "Account" page. If you signed up to SKWEEK using an account with a third party as a Payment Method and wish to cancel your membership, you may need to do so via such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the SKWEEK services through that third party.

e. Changes to the price and subscription plans: we may change our subscription plans and the price of our service from time to time; however, any price changes or changes to our subscription plans will apply to you no earlier than 30 days following written notice (email sufficient) to you.

4. SKWEEK SERVICE

a. You must be 18 years of age (or the age of majority in your province, territory or country) or over to subscribe to the SKWEEK service. Minors may only use the service under the supervision of an adult.

b. Any SKWEEK Content viewed through the service is for your personal and non-commercial use only and may not be shared with individuals beyond your household. During your subscription we grant to you a limited, non-exclusive, non-transferable right to access the SKWEEK and view SKWEEK Content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.

c. You may view the SKWEEK content primarily within the country in which you have established your account and only in geographic locations where we offer our service and have licensed such content. The EuroLeague TV Content available to watch will vary by geographic location and may change from time to time.

d. The SKWEEK Content is regularly updated. In addition, we continually test various aspects of our service, including our website, user interfaces, promotional features and availability of SKWEEK Content.

e. You agree to use the SKWEEK service, the SKWEEK Content, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the SKWEEK service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in SKWEEK; use any robot, spider, scraper or other automated means to access SKWEEK; decompile, reverse engineer or disassemble any software or other products or processes accessible through SKWEEK; insert any code or product or manipulate the content of SKWEEK in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with SKWEEK, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.

SKWEEK software is designed to enable viewing of SKWEEK Content through SKWEEK ready devices. This software may vary by device and medium, and functionalities and features may also differ between devices. You acknowledge that the use of the service may require third party software that is subject to third party licenses. You agree that you may automatically receive updated versions of the SKWEEK and related third-party software.

g. In the event of a software update which is not strictly necessary to maintain the conformity of the service, we shall inform you in advance within a reasonable period of time, and you shall have the right to refuse the update if the update has a negative impact on your access to or use of the service.

5. PASSWORDS AND ACCOUNT ACCESS

The member who created the SKWEEK account and whose Payment Method is charged (the "Account Owner") has access and control over the SKWEEK account and the SKWEEK ready devices that are used to access our service and is responsible for any activity that occurs through the SKWEEK account. To maintain control over the account and to prevent anyone from accessing the account (which would include information on viewing history for the account), the Account Owner should maintain control over the SKWEEK ready devices that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You, the Account Owner, are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, Fedcom Group and its affiliates or our partners from identity theft or other fraudulent activity.

6. GUARANTEE

Legal guarantee of conformity for digital services

Article L.224-25-12 of the French Consumer Code:

‘’The trader shall provide digital content or a digital service in conformity with the contract and with the criteria set out in Article L. 224-25-14 [of the Consumer Code]. Where the contract provides for a one-off supply of the digital content or service, or a series of separate supplies, the trader shall be liable for any lack of conformity existing at the time of the supply and which becomes apparent within two years of the supply. Where the contract provides for the digital content or service to be supplied on a continuous basis, the trader shall be liable for any lack of conformity which becomes apparent during the period in which the digital content or service is supplied under the contract.’

In accordance with Article 2224 of the Civil Code, the period of the guarantee of conformity applies subject to the limitation period of five (5) years from the consumer's knowledge of the lack of conformity.’

Warranty for hidden defects

Article 1641 of the French Civil Code:

The trader is bound by the warranty due to hidden defects in the sold product which render it unfit for the use for which it is intended, or which so diminish this use that the customer would not have acquired it, or would only have paid a lower price for it, if he had known about them.

7. DATA PRIVACY

By using the SKWEEK platform and services, you may provide Fedcom Group with or Fedcom Group collects certain personal data, including the registration data and certain other information about you. By accessing or using the SKWEEK platform and services, or submitting your personal information, you agree to EuroLeague's use of such data in accordance with the Privacy Policy.

As a EuroLeague TV subscriber, you will periodically receive e-mails regarding your subscription. In addition, upon your express consent, you will receive information by e-mail regarding discounts, updated and new offerings regarding SKWEEK and other products and services of the EuroLeague Basketball and its partners. If you wish to change your email preferences you can visit "My Account" where you can change your information, or you can contact helpdesk@fedcomgroup.com

Fedcom takes all technical and organisational measures necessary to ensure the security of the platform and service and to prevent a breach of the integrity, confidentiality and availability of the data. Any security incident will lead to the activation of our incident management procedure.

8. LIMITATION OF LIABILITY

a. To the maximum extent permitted by applicable law, Fedcom Group, its affiliates and any of its directors, officers, employees, agents, licensors and/or suppliers of the foregoing shall not have any liability for any indirect, punitive, actual, consequential, incidental, special or exemplary damages whatsoever for any reason arising in connection with these Terms of Use and or SKWEEK, regardless of the basis upon which liability is claimed and even if advised of the possibility of such loss or damage.

b. Without limiting the generality of the foregoing, to the maximum extent permitted by applicable law, Fedcom Group, its affiliates and any of its directors, officers, employees, agents, licensors and/or suppliers of the foregoing, shall have no liability for any damages or injury caused, in whole or in part, by contingencies or issues beyond their reasonable control, including but not limited to: acts of third parties, errors in the content or service, network failures, internet failures, software and hardware failures, viruses and other system attacks, labor stoppages, riots, acts of government or god, natural disasters, acts of terrorism (or credible threat thereof), communication line failure, or theft, destruction of, unauthorized access to, alteration of or use of records. The foregoing limitations shall apply regardless of whether (i) liability or damage is alleged for breach of contract, tortious behavior, negligence or under any other theory or cause of action, and/or (ii) the party against which liability or damages is sought was advised of the possibility thereof.

9. CONTENT OWNERSHIP, USAGE RESTRICTIONS

a. The content available through SKWEEK is the property of Fedcom Group and/or third parties (including, but not limited to, its affiliates), and is protected by copyright and other intellectual property laws of the European Union and other jurisdictions. The SKWEEK Content may only be used or viewed by you for your personal, non-commercial use only, and you agree not use the content in a manner that would achieve commercial gain. With respect to your use of SKWEEK, you agree (i) to keep intact all copyright and other proprietary notices; (ii), not to use the SKWEEK Content in a manner that would damage the goodwill associated with or compete with Fedcom Group or its affiliates; (iii) not to use the content in a manner that suggests an association with any of our services, brands, or products; and (iv) to make no modifications to the SKWEEK Content. Additionally, you agree to use SKWEEK in a manner that complies with all applicable laws. You agree not to copy, deep link, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the content received through the Service to anyone, including, but not limited to, others in the same company or organization, without the express prior written consent of Fedcom Group.

b. You may not attempt to circumvent technological measures employed to control access to, or the rights in, SKWEEK, whether in conjunction with or through use of any device, software program, service or otherwise.

c. In addition, without limiting the generality of the foregoing, you acknowledge and agree that:

i. No trademarks of any provider of SKWEEK Content (including, but not limited to, Fedcom Group) may be used by you and none of the SKWEEK Content will be rebroadcast, retransmitted or otherwise used by you;

ii. No admission will be charged by you for viewing any of the programming available through SKWEEK;

iii. Notwithstanding anything herein to the contrary, any violation of these provisions may be prosecuted by us or by SKWEEK Content providers in any court of competent jurisdiction; and

d. The EuroLeague Basketball and its competitions names and logos and names are the property of EuroLeague Ventures SA. Trademarks, logos and service marks (collectively, the "Trademarks") appearing in SKWEEK are Trademarks of their respective owners. Nothing contained in SKWEEK should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trademark displayed in SKWEEK without the written permission of its respective owner. Your use of the Trademarks displayed in SKWEEK, or any other content in EuroLeague TV, except as provided in the Terms of Use, is strictly prohibited.

e. Images of people or places displayed in SKWEEK are either the property of, or used with permission by, us. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms of Use or specific permission provided elsewhere in SKWEEK. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. We neither warrant nor represent that your use of materials displayed in SKWEEK will not infringe rights of third parties not owned by or affiliated with us.

In addition, through SKWEEK we may make available statistics, including statistics generated and/or calculated by us or our designee using proprietary calculations and analyses, relating to or arising out of the performance of players during or in connection with EuroLeague Basketball, the EuroLeague Basketball games, competitions or events (collectively, "EuroLeague Statistics"). By using such EuroLeague Statistics, you agree that: (1) any use, display or publication of the EuroLeague Statistics shall include a prominent attribution in connection with such use, display or publication; (2) the EuroLeague Statistics may only be used, displayed or published for legitimate news reporting or private, non-commercial purposes; (3) the EuroLeague Statistics may not be used in connection with any sponsorship or commercial identification; (4) the EuroLeague Statistics may not be used or referred to in connection with any gambling activity (including legal gambling activity); (5) the EuroLeague Statistics may not be used in connection with any fantasy game or other commercial product or service; (6) the EuroLeague Statistics may not be used in connection with any product or service that presents a live, near-live or other real-time or archived play-by-play account or depiction of any EuroLeague Basketball game; and (7) the EuroLeague Statistics may not be used in connection with any website, product or service that features a database (in any medium or format) of comprehensive, regularly updated statistics from EuroLeague Basketball games, competitions or events without our express prior consent.

10. MISCELLANEOUS

a. Governing Law. These Terms of Use shall be governed by and construed in accordance with the laws of France Group. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.

b. Mediation. In case of disputes, we will try to resolve it quickly and efficiently. If we cannot resolve a dispute using our internal complaint handling procedure, you may contact the following mediator :

The solution proposed by the mediator is not binding on the Parties, who remain free at all times to leave the mediation process.

c. Court : In case of dispute, the relevant courts of France will have exclusive jurisdiction in relation to this Terms of Use.

e. Survival. If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.

Changes to Terms of Use. EuroLeague may, from time to time, change these Terms of Use. We will notify you at least 30 days before such changes apply to you.

Electronic Communications. We will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
